Terms of Service

By accessing or using Famara ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Famara, operated by AXD Intelligence, ABN 36 242 601 526 ("we", "us", or "our").

You must be at least 18 years old to create a Famara account. By creating an account, you represent that you are of legal age to form a binding contract. An adult account holder who owns a family group may add an underage family member to that group; doing so is the adult's representation that they are that minor's parent or legal guardian, that they consent on the minor's behalf to these Terms and the Privacy Policy, and that they are responsible for that minor's use of the Service. See our Privacy Policy, Section 9, for details on family accounts and the safety monitoring that applies to a minor family member's use, and our Child Safety & Wellbeing Policy for the protections applied to every under-18 account. Famara is not a crisis or emergency service — in an emergency call 000.

Famara is a free AI aggregator platform that provides access to multiple AI providers through a unified interface. The Service includes:

• Free access to multiple AI models (Groq, DeepSeek, Together.ai, Cohere, and others)
• Smart routing to optimize for speed, cost, and availability
• Text generation, code generation, and analysis capabilities
• Optional file upload and processing features
• User account management and authentication

Service Availability: While we strive for 99.9% uptime, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or third-party provider limitations.

3.1 Account Creation:

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One account per person; multiple accounts may be terminated without notice

3.2 Account Security:

• Use a strong, unique password (minimum 8 characters with mixed case, numbers, symbols)
• Enable two-factor authentication when available
• Do not share your account credentials with third parties
• You are liable for all activities under your account

3.3 Account Termination:

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose security risks. You may delete your account at any time through account settings.

You agree NOT to use the Service to:

• Violate any local, state, national, or international law or regulation
• Generate illegal content (child exploitation, terrorism, hate speech, etc.)
• Harass, abuse, threaten, or intimidate individuals or groups
• Impersonate any person or entity, or falsely state affiliation
• Distribute malware, viruses, or malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Scrape, mine, or extract data without explicit permission
• Overload or disrupt the Service through excessive requests (rate limiting applies)
• Generate spam, phishing content, or fraudulent materials
• Bypass usage limits, payment systems, or security measures
• Use the Service for commercial purposes without a paid plan (when applicable)
• Train competing AI models using our Service outputs

Enforcement: Violations may result in immediate account suspension, termination, legal action, and reporting to law enforcement authorities.

5.1 Service Content:

All Service content, including but not limited to software, design, text, graphics, logos, and trademarks, are owned by Famara or licensed to us. You may not copy, modify, distribute, or create derivative works without written permission.

5.2 User-Generated Content:

• You retain ownership of content you input into the Service (prompts, files, etc.)
• You grant us a worldwide, non-exclusive, royalty-free license to process your content solely for providing the Service
• We do NOT claim ownership of your inputs or AI-generated outputs
• You are responsible for ensuring you have rights to content you upload

5.3 AI-Generated Content:

AI outputs are generated by third-party providers. While we facilitate access, we make no claims to ownership. You may use AI outputs subject to provider terms. Be aware that AI models may generate similar outputs for similar prompts across different users.

DMCA Compliance: We comply with the Digital Millennium Copyright Act. To report copyright infringement, contact: legal@famara.ai with subject "DMCA Notice".

Your privacy is important to us. Please review our Privacy Policy for detailed information on how we collect, use, and protect your data.

Key Points:

• GDPR Compliance: EU users have rights to access, rectify, erase, and port their data under GDPR
• CCPA Compliance: California residents have rights to know, delete, and opt-out of data sales
• Data Security: We use industry-standard encryption (AES-256, TLS 1.3) and secure authentication
• Third-Party Sharing: Your prompts are sent to AI providers for processing. We do NOT sell your personal data
• Data Retention: Account data retained while active; conversation history for 90 days unless deleted

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

7.1 No Warranties:

• We do not guarantee accuracy, completeness, or reliability of AI-generated content
• AI outputs may contain errors, biases, or hallucinations
• We are not responsible for decisions made based on AI outputs
• The Service may experience downtime, bugs, or data loss
• Third-party AI providers may change or discontinue services without notice

7.2 Limitation of Liability:

To the extent permitted by the Australian Consumer Law and other applicable law, AXD Intelligence's liability to you for any claim arising out of or in connection with these Terms or the Service is limited to the total fees paid by you to AXD Intelligence in the 12 months immediately preceding the date the claim arose, or AUD $100 if no fees have been paid. This limitation does not apply to liability for personal injury, death, fraud, or gross negligence, or to any liability that cannot be limited under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

7.3 Indemnification:

You agree to indemnify and hold harmless AXD Intelligence and its officers and employees from any claims, damages, or reasonable legal costs arising directly from: (a) your breach of these Terms; (b) content you submit through the Service; (c) your use of the Service in violation of applicable law; or (d) your infringement of a third party's rights. This indemnity does not apply to the extent that the claim arises from AXD Intelligence's own negligence or breach of these Terms.

7.4 Not Professional Advice:

Famara is a technology tool and does not provide legal, financial, medical, building inspection, nutritional, or any other professional advice. AI-generated outputs are not a substitute for professional advice from a qualified practitioner. Do not make decisions affecting your health, finances, legal rights, or property based solely on outputs from Famara. Famara is not a financial services licensee, legal practitioner, registered medical professional, or registered building inspector.

While the core Service is free, we may offer paid tiers with additional features:

8.1 Pricing and Plans:

• Pricing is displayed in USD and subject to change with 30 days notice
• Billing cycles: Monthly or annual subscriptions
• All prices exclude applicable taxes (VAT, GST, sales tax)

8.2 Payment Processing:

• Payments processed through Stripe (PCI-DSS compliant)
• We do NOT store your full credit card information
• Automatic renewal unless canceled before billing date

8.3 Refunds:

See our Refund Policy for detailed information. Generally, refunds available within 14 days of purchase if Service not accessed.

8.4 Cancellation:

You may cancel subscriptions at any time. Access continues until end of billing period. No pro-rated refunds for partial months.

Famara integrates with third-party AI providers (Groq, DeepSeek, Together.ai, Cohere, etc.). These providers have their own terms of service and privacy policies.

Important:

• Your prompts may be subject to third-party provider terms and usage policies
• We are not responsible for third-party service availability, accuracy, or data practices
• Provider terms may restrict certain use cases (commercial use, competitive analysis, etc.)
• Links to external websites are provided for convenience; we do not endorse their content

We may update these Terms from time to time. For material changes (changes to pricing, liability, data handling, or your key rights), we will provide at least 14 days notice via email (if you have provided one) and an in-app notification before the change takes effect. For non-material changes (corrections, clarifications, new features), changes take effect upon posting.

If you do not agree to a material change, you may close your account before the change takes effect and you will not be bound by the new terms. Continued use of the Service after a change takes effect constitutes your acceptance of the updated Terms.

11.1 Governing Law:

These Terms are governed by the laws of Western Australia, Australia, without regard to conflict of law principles.

11.2 Dispute Resolution:

Before commencing legal proceedings, we ask that you contact us at legal@famara.ai to attempt to resolve any dispute in good faith. We will endeavour to respond within 5 business days and resolve the matter within 30 days where possible. This does not limit your right to commence proceedings at any time.

These Terms are subject to the non-exclusive jurisdiction of the courts of Western Australia and any courts of appeal from those courts. Nothing in these Terms limits your right to commence proceedings in any court of competent jurisdiction, including the relevant state consumer tribunal (WA: State Administrative Tribunal) or the Australian Competition and Consumer Commission.

Australian Consumer Law: Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. If the Australian Consumer Law applies and permits us to limit our liability, our liability is limited to re-supplying the services or paying the cost of re-supplying the services, at our election.

12.1 Entire Agreement:

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Famara.

12.2 Severability:

If any provision is found unenforceable, remaining provisions remain in full effect.

12.3 Waiver:

Failure to enforce any provision does not waive our right to enforce it later.

12.4 Assignment:

You may not assign these Terms. We may assign to affiliates or in connection with merger, acquisition, or asset sale.

12.5 Force Majeure:

We are not liable for failure to perform due to circumstances beyond reasonable control (natural disasters, war, pandemics, internet outages, etc.).

12.6 Export Control:

The Service may be subject to export control laws. You agree to comply with all applicable laws and not export or re-export in violation of such laws.
